Justice N.V. Shravan Kumar of Telangana High Court directed the Cyberabad Police Commissioner to supervise an inquiry into the allegations of a doctor couple, against whom their own daughter lodged a complaint resulting in registration of a criminal case, that their complaints in the matter were not acted upon by the Miyapur police station Inspector.
The judge directed the Commissioner to take appropriate action in the matter strictly in accordance with law. The order was passed in a writ petition filed by the doctor couple seeking re-investigation into the case registered against them based on the complaint lodged by their own daughter, a medico. They requested the court to transfer the case, registered against them under different sections of BNS and POCSO Act, to any independent agency or the CBI for re-investigation.
They contended that Miyapur Inspector did not act upon their complaints about their daughter being trapped by a married man with whom she was presently living but had registered a criminal case against them following a complaint by their daughter. The doctor couple maintained that their daughter was suffering from some mental ailment and required treatment. By virtue of being doctors, they had complete knowledge of the medical history of their daughter, their counsel informed the court.
They alleged that the married man was ‘exploiting their daughter on the pretext of love jihad’ and attempting to grab their properties through wrong means. Since a case was registered and charge-sheet was also filed based on the complaint of their daughter, it was appropriate to direct the Inspector to consider the complaints of the parents act upon them, the judge said. Since the parents accused the Inspector of not acting upon their complaints, the Commissioner was directed to oversee the inquiry.
The judge noted that it was suggested to assign the inquiry to the Madhapur Deputy Commissioner of Police since the post was held by a lady officer.
