The Gujarat High Court on Friday disposed of a petition filed by the MEDGUJ Association of Gujarat Medical Colleges after the Medical Counselling Committee (MCC) informed the court that it had issued notifications to carry out further rounds of admissions to fill up the vacant seats, prompting the petitioners to withdraw the plea. The committee told the court that it would possibly do a “fourth or fifth round of admission” and fill up all the seats.
The HC was hearing a plea of MEDGUJ Association against the Medical Counselling Committee (MCC), National Medical Commission and Admission Committee for Professional Undergraduate Medical Courses (ACPUMC), contending that the authorities were reluctant to hold further rounds of admissions for MBBS course despite several seats remaining vacant at the end of the three rounds of admissions conducted by ACPUMC. The petition had also contended that the decision was contrary to the previous year when the authorities had conducted an additional round of admission for four vacant seats and was “not in the interest” of desirous students.
Justice Nirzar S Desai of the Gujarat High Court in an oral order on Friday granted liberty to the petitioners to file a fresh petition in case of difficulty in the future. The Additional Advocate General ML Shah and Additional Government Pleader KM Antani, who were appearing for the respondent Admission Committee for Professional Undergraduate Medical Courses, had submitted a copy of the notification issued by the MCC, stating that it would conduct further rounds of admission to fill up vacant seats of MBBS course in the state.
In its oral order, the HC stated that the copy of the notification issued by MCC has “declared that, possibly, there shall be fourth and even fifth round of admission in MBBS Course and all the seats remaining vacant in MBBS Course will be filled up… In view of the above (advocates appearing for the petitioner), under the instructions, sought permission to withdraw this petition with a liberty to file a fresh petition in case of difficulty.”
On December 15, the Gujarat HC, in an oral order, directed the authorities to file an affidavit to justify the denial for further admissions to vacant seats questioning, “what is the impediment and what is the justifiable reason for not going on with one more round of admission for MBBS course”. In its oral order, the court had considered the submissions of the petitioners that “this year also, there are as many as 57 seats likely to remain vacant for MBBS course and as there are a number of students, who are desirous to take admission in the MBBS course, there is a need for conducting one more round of admission for admission to the course of MBBS.”
The petitioners had informed the court that the MCC and the NMC had, on December 14, resolved to undertake an additional round of admission to the BDS Course and therefore, “similar methodology could have been adopted in the case of MBBS Course as well, looking to the number of students desirous to take admission in MBBS Course.”
